Terms and Conditions

1. GENERAL PROVISIONS

1.1. The online store available at www.sassycollective.pl is operated by SASSY COLLECTIVE spółka z ograniczoną odpowiedzialnością, with its registered office at ul. Pajęcza 28A, 04-806 Warsaw, Poland, entered into the National Court Register under KRS number 0001221130, NIP: 9522280109, REGON: 543865350, email address: contact@sassycollective.pl, hereinafter referred to as the “Seller”, the “Service Provider” or the “Store”.

1.2. These Terms & Conditions define the rules for using the Online Store, placing orders, concluding sales agreements, making payments, delivering products, withdrawing from agreements, submitting complaints, and using electronic services available in the Store.

1.3. These Terms & Conditions apply to both consumers and entrepreneurs using the Online Store, unless a specific provision states otherwise.

1.4. The Seller is the controller of personal data processed in connection with the use of the Online Store. Detailed information regarding the processing of personal data, cookies, and analytical tools is provided in the Privacy Policy available on the Store’s website.

1.5. Using the Online Store, including placing orders, is voluntary. Providing personal data is voluntary; however, it may be necessary to place an order, create an account, subscribe to the newsletter, handle a complaint, or fulfill the Seller’s legal obligations.

2. DEFINITIONS

For the purposes of these Terms & Conditions, the following definitions apply:

2.1. Business Day — any day from Monday to Friday, excluding public holidays in Poland.

2.2. Registration Form — a form available in the Online Store allowing the creation of an Account.

2.3. Order Form — an interactive form available in the Online Store allowing the Customer to place an Order, in particular by adding Products to the cart and specifying the terms of the Sales Agreement, including delivery and payment methods.

2.4. Customer — a natural person, legal person, or organizational unit with legal capacity that has concluded or intends to conclude a Sales Agreement with the Seller.

2.5. Consumer — a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity.

2.6. Entrepreneur with consumer rights — a natural person entering into an agreement directly related to their business activity, where the content of the agreement indicates that it is not of a professional nature for that person.

2.7. Account — an electronic service available in the Online Store, secured with a login and password, allowing the Customer to access, among other things, registration data and order history.

2.8. Newsletter — a free electronic service consisting of sending information about Products, new arrivals, promotions, and marketing activities of the Store to the email address provided by the user.

2.9. Product — a movable item available in the Online Store and subject to a Sales Agreement between the Customer and the Seller.

2.10. Terms & Conditions — these Terms & Conditions of the Online Store.

2.11. Online Store — the online store operated by the Seller at www.sassycollective.pl.

2.12. Sales Agreement — a product sales agreement concluded between the Customer and the Seller through the Online Store.

2.13. Electronic Service — a service provided electronically by the Service Provider via the Online Store.

2.14. Service User — a person using or intending to use an Electronic Service.

2.15. Order — a declaration of intent submitted by the Customer via the Order Form, directly aimed at concluding a Sales Agreement with the Seller.

3. ELECTRONIC SERVICES IN THE ONLINE STORE

3.1. The following Electronic Services are available in the Online Store: Account, Order Form, and Newsletter.

3.2. Use of the Account is possible after completing the Registration Form, providing the required data, and creating a login and password. The Account service is provided free of charge for an indefinite period.

3.3. The Service User may delete the Account at any time and without giving a reason by sending a request to contact@sassycollective.pl or in writing to the Seller’s registered office address.

3.4. Use of the Order Form begins when the Customer adds a Product to the cart. An Order is placed after completing the Order Form and clicking the button confirming the purchase.

3.5. Until the Order is placed, the Customer may independently modify the entered data and the contents of the cart.

3.6. The Order Form service is provided free of charge, is one-off in nature, and ends when the Order is placed or when the Customer discontinues the ordering process.

3.7. Use of the Newsletter begins after providing an email address and consenting to receive marketing content. The Newsletter is provided free of charge for an indefinite period.

3.8. The Service User may unsubscribe from the Newsletter at any time using the unsubscribe link included in the email or by contacting the Seller at contact@sassycollective.pl.

3.9. The technical requirements necessary to use the Online Store are: a device with Internet access, an active email address, an up-to-date web browser, and enabled cookies and JavaScript.

3.10. The Service User is obliged to use the Online Store in accordance with the law, good practices, and with respect for the rights of the Seller and third parties. Providing unlawful content is prohibited.

4. CONCLUSION OF THE SALES AGREEMENT

4.1. The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order using the Order Form and the Seller accepts it for processing.

4.2. Product prices are stated in Polish zloty and include taxes. Before placing an Order, the Customer is informed of the total price of the Products, delivery costs, and any other applicable costs.

4.3. After the Order is placed, the Seller confirms its receipt and acceptance for processing by sending an email to the address provided by the Customer.

4.4. The Sales Agreement is concluded when the Customer receives the email confirming acceptance of the Order for processing.

4.5. The content of the Sales Agreement is recorded, secured, and made available to the Customer by making these Terms & Conditions available on the Store’s website and by sending the Order confirmation to the Customer’s email address.

5. PAYMENTS

5.1. The Seller provides the following payment methods:

  • fast online payments handled by PayU S.A.,
  • payment by Visa or Mastercard,
  • other payment methods made available in the Store during the ordering process.

5.2. Detailed information about available payment methods is displayed in the Online Store when placing an Order.

6. DELIVERY

6.1. Product delivery is available within the territory of the Republic of Poland and, after prior contact with the Seller, within other European Union countries.

6.2. Standard delivery is paid for orders up to PLN 299. For orders above this amount, delivery is free of charge unless a specific delivery method states otherwise. Free delivery does not apply to the InPost Weekend Delivery service unless the Store clearly states otherwise.

6.3. The Seller provides the following delivery methods:

  • InPost parcel lockers,
  • InPost courier,
  • other delivery methods available in the Store during the ordering process.

6.4. The delivery time is up to 5 Business Days unless a different time is specified in the Product description or during the ordering process.

6.5. If Products in one Order have different delivery times, the delivery time for the entire Order is the longest indicated time.

6.6. The delivery time starts from the date the payment is credited to the Seller’s bank account or settlement account.

6.7. For an Order to be delivered during the weekend, it should be placed by Friday at 1:00 PM at the latest, and the “InPost Weekend Delivery” option should be selected, if available.

7. COMPLAINTS REGARDING ELECTRONIC SERVICES

7.1. Complaints regarding the operation of the Online Store or the provision of Electronic Services may be submitted electronically to contact@sassycollective.pl.

7.2. It is recommended that the complaint include a description of the issue, the date of occurrence, the Service User’s request, and contact details. Failure to provide this information does not affect the validity of the complaint but may help speed up its processing.

7.3. The Seller will respond to the complaint promptly, no later than within 14 calendar days from the date of receipt.

8. PRODUCT COMPLAINTS — LACK OF CONFORMITY WITH THE AGREEMENT

8.1. The Seller is obliged to deliver a Product that conforms to the Sales Agreement.

8.2. In the case of a Customer who is a Consumer or an Entrepreneur with consumer rights, the Seller’s liability for lack of conformity of the Product with the Sales Agreement is governed by the provisions of the Polish Consumer Rights Act.

8.3. A complaint may be submitted:

  • in writing to: SASSY COLLECTIVE sp. z o.o., ul. Pajęcza 28A, 04-806 Warsaw, Poland,
  • electronically to: contact@sassycollective.pl.

8.4. It is recommended that the complaint include: a description of the lack of conformity, the date it was identified, the Customer’s request, and contact details. Failure to provide this information does not affect the validity of the complaint but may help process it more efficiently.

8.5. In the event of lack of conformity of the Product with the Agreement, the Customer may request repair or replacement of the Product. In cases specified by law, the Customer may also submit a statement requesting a price reduction or withdrawal from the agreement.

8.6. The Seller will review the complaint promptly, no later than within 14 calendar days from the date of receipt.

8.7. The Customer submitting a complaint should make the Product subject to the complaint available to the Seller. If necessary, the Seller will inform the Customer about the further procedure.

8.8. In the case of a Customer who is neither a Consumer nor an Entrepreneur with consumer rights, the Seller’s liability under statutory warranty for the Product is excluded pursuant to Article 558 § 1 of the Polish Civil Code.

9. WITHDRAWAL FROM THE AGREEMENT AND RETURNS

9.1. A Customer who is a Consumer or an Entrepreneur with consumer rights and who has concluded a distance agreement may withdraw from it within 14 calendar days without giving any reason.

9.2. The withdrawal period begins on the day the Customer or a third party indicated by the Customer, other than the carrier, takes possession of the Product.

9.3. A withdrawal statement may be submitted:

  • in writing to: SASSY COLLECTIVE sp. z o.o., ul. Pajęcza 28A, 04-806 Warsaw, Poland,
  • electronically to: contact@sassycollective.pl.

9.4. To meet the withdrawal deadline, it is sufficient to send the statement before the deadline expires.

9.5. In the event of withdrawal from the agreement, the Sales Agreement is considered not concluded.

9.6. The Seller will refund the payments made by the Customer, including the cost of the cheapest standard delivery method available in the Store, no later than within 14 calendar days from the date of receiving the withdrawal statement.

9.7. The Seller may withhold the refund until the Product is received back or until the Customer provides proof of return shipment, whichever occurs first.

9.8. The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to another refund method that does not involve any additional costs.

9.9. The Customer is obliged to return the Product promptly, no later than within 14 calendar days from the date of withdrawal from the agreement.

9.10. The Product may be returned to: SASSY COLLECTIVE sp. z o.o., ul. Pajęcza 28A, 04-806 Warsaw, Poland, or through the return method made available by the Store, if available.

9.11. The Customer bears the direct cost of returning the Product unless the Seller clearly states otherwise.

9.12. The Customer is liable for any decrease in the value of the Product resulting from using it in a way that goes beyond what is necessary to determine its nature, characteristics, and functioning.

9.13. If the Customer selected a delivery method other than the cheapest standard delivery method available in the Store, the Seller is not obliged to refund the additional delivery costs.

9.14. If the Customer does not collect the shipment containing the Order, the Seller may charge the Customer with justified costs of return shipment to the Seller, provided this is permitted by applicable law.

10. OUT-OF-COURT DISPUTE RESOLUTION

10.1. Consumers may use out-of-court methods of complaint handling and claim enforcement.

10.2. Detailed information regarding out-of-court consumer dispute resolution is available on the website of the Polish Office of Competition and Consumer Protection.

10.3. Consumers may seek assistance from municipal or district consumer ombudsmen, consumer organizations, or the competent Provincial Inspectorate of Trade Inspection.

10.4. The Seller informs that it is not obliged and does not undertake to use out-of-court dispute resolution methods unless such an obligation results from mandatory provisions of law.

11. PROVISIONS CONCERNING ENTREPRENEURS

11.1. The provisions of this section apply only to Customers and Service Users who are not Consumers or Entrepreneurs with consumer rights.

11.2. The Seller has the right to withdraw from a Sales Agreement concluded with a non-consumer Customer within 14 calendar days from the date of its conclusion, without giving any reason and without any claims arising on the Customer’s side.

11.3. The Seller has the right to limit available payment methods and to require full or partial prepayment.

11.4. The Service Provider may terminate an agreement for the provision of an Electronic Service with immediate effect if the Service User violates these Terms & Conditions, the law, or good practices.

11.5. The Seller’s liability towards a non-consumer Customer, regardless of the legal basis, is limited to the amount of the price paid and delivery costs under the relevant Sales Agreement, but not more than PLN 1,000.

11.6. The Seller is not liable towards a non-consumer Customer for lost profits, indirect damages, or shipment delays caused by the carrier.

11.7. Any disputes arising between the Seller and a non-consumer Customer shall be submitted to the court having jurisdiction over the Seller’s registered office.

12. FINAL PROVISIONS

12.1. Agreements concluded through the Online Store are concluded in Polish.

12.2. The Seller reserves the right to amend these Terms & Conditions for valid reasons, in particular in the event of changes in law, payment methods, delivery methods, Store functionalities, or the Seller’s details.

12.3. Amendments to these Terms & Conditions do not affect the acquired rights of Customers before the effective date of the amendments, in particular Orders placed before the amendment.

12.4. In the case of continuous services, such as the Account, the amended Terms & Conditions bind the Service User if the Service User has been properly informed of the amendments and has not terminated the agreement within the period specified in the notification.

12.5. In matters not regulated by these Terms & Conditions, the provisions of Polish law apply, in particular the Polish Civil Code, the Polish Consumer Rights Act, and the Act on the Provision of Electronic Services.
